Thekharsofsaless provides high-level digital marketing services including Creative-Led Growth Strategy, Omnichannel Retargeting Loops, TikTok Spark Ads Management, Meta Advantage+ Shopping Campaigns, and Instant Experience (IX) Canvas Ads. Our services are designed to scale brands through data-driven and creative-led methodologies. While we strive for the highest level of excellence and ROI, the client acknowledges that digital marketing and paid social advertising are subject to platform algorithm changes and market volatility. We do not guarantee specific financial outcomes or sales figures, as these are influenced by external factors beyond our control, such as product-market fit, website conversion rates, and third-party platform policies.
California Privacy Rights and Data Protection
In compliance with the California Consumer Privacy Act (CCPA) and the California Online Privacy Protection Act (CalOPPA), we are committed to protecting the privacy of our users. Payment Terms and Cancellation Policy
Clients engaging in our paid social management plans agree to pay the fees specified in their chosen package (Starter, Performance, or Elite). All payments are due in advance of the service month. Please note that management fees are separate from “Ad Spend,” which is paid directly by the client to the advertising platforms like Meta or TikTok. Under California business codes, we maintain a transparent billing cycle; however, because of the intensive nature of creative strategy and setup, all fees paid to Thekharsofsaless are non-refundable. To cancel a recurring service, the client must provide a written notice at least 15 days before the next billing cycle begins. Failure to pay on time may result in the immediate suspension of all active ad campaigns and services.
Intellectual Property and Usage Rights
All original creative assets, including ad copy, graphic designs, and video edits produced by Thekharsofsaless, remain our intellectual property until full payment for the respective service period has been received. Upon full payment, the client is granted a non-exclusive, non-transferable license to use these creatives solely for the intended advertising purposes. We reserve the right to showcase the results, case studies, and creative work produced for the client in our portfolio and marketing materials, unless a non-disclosure agreement (NDA) has been explicitly signed by both parties. You may not reproduce, redistribute, or sell any of our strategic frameworks or proprietary methodologies to third parties without our express written consent.
Limitation of Liability and Governing Law
To the maximum extent permitted by California law, Thekharsofsaless and its employees shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our services or website. This includes, but is not limited to, loss of profits, data, or business reputation due to ad account bans, platform glitches, or market shifts. This agreement is governed by the laws of the State of California, USA, without regard to its conflict of law provisions. Any legal action or proceeding related to this website or our services shall be brought exclusively in a federal or state court of competent jurisdiction sitting in California.
